How long do I have to file a personal injury lawsuit in Illinois?

The time you have to file a personal injury lawsuit in Illinois (called the “statute of limitations”) can vary based on the type of case you file. It is generally two years from the date you were injured or reasonably could have known you were injured, but there are exceptions. Children under the age of 18 have until their 20th birthday the latest to file a claim, whereas claims against the government must be put in motion within 180 days.

Medical malpractice and wrongful death claims are also generally two years. Products liability cases are typically two years from the date of purchase, so you may have less time than you think. It’s one of the reasons why you want to call us as soon as you can.
